1. Preliminary provsions

The following are the legal terms and conditions of sale (“Terms and Conditions”), which apply universally, without exception or limitation, to all transactions concerning the sale of products under the Moremay Cosmetics brand (hereinafter: “Goods”). These transactions take place through the website www.moremay.com (hereinafter: the “Website”) and are provided by Moremay Cosmetics limited liability company (hereinafter: “Moremay Cosmetics”), owner of the Moremay Cosmetics brand and holder of the related intellectual property rights. Moremay Cosmetics spółka z ograniczoną odpowiedzialnością is registered in Poland under the number 0000950068, with its registered office at ul. Królewicza Jakuba 83, 02-956 Warsaw. The Terms and Conditions apply to every customer regardless of whether they are a consumer.

You automatically can read these Terms and Conditions before placing an order. It is essential that you carefully read and understand the Terms and Conditions before purchasing any Goods on our Website. By checking the box to accept the Terms and Conditions when confirming your order, you expressly and fully agree to be bound by these Terms and Conditions.

We reserve the right to modify these Terms and Conditions from time to time. The latest version will be available on our Website and will apply to subsequent orders. Users of our Website have the option to electronically save or print these Terms and Conditions.

2. Order and conclusion of contract

2.1. The user must be at least 18 years of age. In addition, you are required to provide and maintain a valid postal address and email address. Orders for Goods are normally placed via our Site. In exceptional cases and at the discretion of Customer Service, some orders may be taken by telephone.

2.2. Details of the Goods available for purchase can be found on our Site, including product descriptions. These descriptions include relevant details such as availability, composition, fitness for purpose, use, quantity, specification and expected results of use. You are solely responsible for your choice of Goods.

2.3. We reserve the right to change and/or improve our Goods or the formulas presented on the Site at any time without prior notice. Accordingly, some Goods may become unavailable without warning. We shall not be liable if the Goods are no longer available or have been removed from sale.

2.4. To initiate an order, the User has the option to create a dedicated account on the Site by providing the necessary personal data via the order form. This makes it possible not only to accumulate loyalty points, but also to track the progress of the order and view the purchase history. Alternatively, the User can simply provide the information necessary to process the order and its delivery.

2.5. Next, add the selected Goods to the shopping cart. The availability status of the Goods is clearly visible on the Website. If any Goods are unavailable, this information will be clearly communicated on our Website and you may register your email address to receive updates regarding their availability. In such cases, we will notify you by email of the availability of previously unavailable Goods, providing you with the opportunity to pre-order them.

2.6. You will be given the opportunity to check your selection, verify the total price (including VAT) and correct any input errors before finalising your order. The User will then be asked to accept the Terms and Conditions by ticking the box indicated and proceeding to payment, as detailed below. In the event of prolonged inactivity resulting in a connection failure to our Site, the selected Goods may be lost, requiring you to make your selection again.

2.7. The sale becomes binding on our part only after a confirmation e-mail has been sent, which contains the details of the order and verifies payment. Once this confirmation has been sent, the order is considered final and cannot be modified or cancelled.

2.8. We reserve the right to refuse and cancel your order:
– if you violate the Terms and Conditions.
– if there is a warehouse error on the Website, which makes the Goods ordered unavailable for sale.

2.9. When you access our Website, you are responsible for paying any connection costs incurred.

2.10. The contract for the supply of the Goods (the “Contract“) shall come into effect once we have accepted your order and verified your payment, confirmed by sending you a confirmation email.

3. Price

3.1. The price of the Goods ordered shall be the price displayed on the Website before the order is confirmed. All prices are quoted in Polish zloty (PLN) and do not include information on shipping costs.

3.2. Additional local import charges and/or duties may apply in certain countries. Please note that the prices of Goods displayed do not include all destination import duties, taxes and charges levied in the recipient’s country. If you select such a DAP (Delivery at Place) destination, you, as the recipient, will be responsible for paying all import duties, customs duties and local sales taxes levied by the country to which you are shipping; payment of these is necessary to release your order from customs clearance upon arrival. We are unable to estimate the amount of these charges as they are regulated by individual governments.

3.3. If you are erroneously invoiced for an amount higher than the actual price of the Goods, we will inform you as soon as possible and offer you the option to reconfirm your order at the correct price or to cancel your order. If the User decides to cancel the Contract, we will refund or re- credit the full amount.

4. Payment

4.1. All payments are made by quick online transfer (Przelewy24.pl).

4.2. For each order, we reserve the right not to offer certain types of payment and to offer others. You are responsible for all financial transaction costs.

4.3. To pay for the ordered products via Przelewy24.pl, please select “Przelewy 24” as the payment method for your order and click “Next”. Then fill in the form with your personal data and click “Order”.

4.4. The next step is to select your bank and confirm your choice by clicking “Pay”. After clicking on “Pay”, the User will be redirected to the website of his/her bank, where he/she will have to follow the messages displayed on the page.

4.5. The User hereby agrees to receive account approval information in electronic form only.

4.6. If for any reason the amount due from the User cannot be collected (including but not limited to withholding of payment or refusal of the card issuer), the order will be cancelled immediately, the Contract will not be concluded, and the User will be notified by email.

4.7. Payment is irreversible.

5. Delivery

5.1. Once the Contract has been duly concluded, the Goods ordered will be delivered to the address provided when placing the order, according to the delivery method selected. Once the Goods have been dispatched, you will be notified by email and will be able to monitor the progress of your order via your dedicated account.

5.2. Orders placed before 12:00 (GMT) will be dispatched the same day, Monday to Friday. Estimated delivery times are as follows:

5.3. Please note that delivery times are approximate, and we will not be liable for any delays or resulting loss or damage.

5.4. Ownership and risk of damage to the Goods shall pass to you on physical receipt of the Goods.

5.5. If the packaging is damaged on delivery, you must open the package in the presence of the carrier to check the condition of the Goods. In the event of damage, note the details on the delivery note, retain any relevant evidence (particularly photographs) and contact the customer service team as described in section 7 below.

5.6. A paper copy of the invoice will be enclosed with the parcel.

6. Liability

6.1. Please note that delivery times are approximate, and we will not be liable for any delays or resulting loss or damage.

6.2. Ownership and risk of damage to the Goods shall pass to you on physical receipt of the Goods.

6.3. If the packaging is damaged on delivery, you must open the package in the presence of the carrier to check the condition of the Goods. In the event of damage, note the details on the delivery note, retain any relevant evidence (particularly photographs) and contact the customer service team as described in section 7 below.

6.4. A paper copy of the invoice will be enclosed with the parcel.

7. Withdrawal right

7.1 Pursuant to the Consumer Rights Act of 30 May 2014, the User may withdraw from a contract concluded online or by telephone without giving any reason within 14 days from the date of delivery of the Goods.

7.2. If the User wishes to exercise this right of withdrawal, the User must notify the Company of the withdrawal within the aforementioned period. The User may do so by writing to the email address support@moremay.pl

7.3. In the event of withdrawal, the User will receive a refund of the price of the Goods. Refund of the price of the Goods shall be made without delay, but no later than within 14 days from the date of withdrawal from the contract.

7.4. In the case of withdrawal from the contract, the User shall send the returned Goods immediately, but no later than within 14 days from the date of withdrawal from the contract to the address: Moremay Cosmetics spółka z ograniczoną odpowiedzialnością, 83 Królewicza Jakuba Street, 02-956 Warsaw. If the User fails to return the Goods within the period indicated in sec. 7.3 Moremay Cosmetics may withhold payment until receipt of the returned Goods.

7.5. The User shall be liable for any diminution in the value of the Merchandise as a result of using it in a manner not intended for that purpose. The User is also not entitled to the right of withdrawal if the Goods have been removed from their packaging and cannot be re-packed for hygienic reasons.

7.6. Goods must be returned in their original packaging, including labels, notices, protective covers, and boxes. The foil covering the box must remain closed. The original invoice must be enclosed.

8. Complaints

8.1. If, on delivery, the Goods are found to be defective you may request a refund or replacement of the Goods from the Company at no cost to you, including the cost of redelivery.

8.2. Goods shall be deemed defective if they do not have the usual or stated characteristics, the goods do not fulfil their purpose or do not comply with the requirements.

8.3. Goods that have caused an increased sensitivity or allergic reaction of the User to the Goods shall not be considered defective.

8.4. Moremay Cosmetics shall be liable for defects in the Goods if the defects become apparent within a period of two years from the date of delivery of the Goods or before the expiry date stated on the packaging.

8.5. If the User wishes to exercise a claim, the User must notify the Company of the User’s wish to claim the Goods as soon as a defect in the Goods is discovered. The User may do so by writing to the email address support@moremay.pl

8.6. If a complaint is used, the User should send the Goods complained of to the address: Moremay Cosmetics spółka z ograniczoną odpowiedzialnością, 83 Królewicza Jakuba Street, 02-956 Warsaw.

8.7. The User’s complaint will be considered immediately, however, no later than within 30 days from the date of filing the complaint.

9. Intellectual property rights

9.1. All rights to the Website, including copyright, intellectual property rights in its name, Internet domain, as well as in the templates, forms and logos posted on the Website, belong to Moremay Cosmetics.

9.2. All symbols, illustrations, images, and logos placed on products, accessories or packaging are the exclusive property of Moremay Cosmetics.

9.3. Any reproduction, in whole or in part, modification or use of the content, of these trademarks, illustrations, images and logos, for any reason and in any medium, without our express, written, and prior consent, is strictly prohibited. This includes any combination or use in conjunction with other trademarks, symbols, logos or, more broadly, any distinctive mark intended to create a composite logo, which may constitute an act of counterfeiting.

10. Use of information

10.1. The processing and use of personal data provided to Moremay Cosmetics sp. z o.o. or any other company belonging to Moremay Cosmetics sp. z o.o. is governed by the Privacy Policy available on the Website, which forms an integral part of these Terms and Conditions. It is important that you read this Privacy Policy carefully to understand how we use and protect the information you provide. By placing an order on the Site, you consent to the collection, use and transfer of your information in accordance with the terms of the Privacy Policy.

11. Protection of personal data

12. Applicable law

13.1 The Contract and any disputes or claims arising out of or in connection with it, its subject matter, or its conclusion (including non-contractual disputes or claims) shall be governed by and construed in accordance with Polish law.

13.2. Any disputes relating to these Terms and Conditions shall be considered by the competent court for the registered office of Moremay Cosmetics spółka z ograniczoną odpowiedzialnością.

13. General

13.1 These Terms and Conditions constitute the entire agreement between the User and the Company and supersede all previous promises, representations (unless false) or undertakings.

13.2. Moremay Cosmetics informs that it does not use alternative dispute resolution methods, i.e. out-of-court means of redress for the conclusion of contracts in the online shop, unless provided for by mandatory legal provisions.

13.3. Pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR for consumer disputes), Moremay Cosmetics informs that an ODR electronic dispute resolution platform is available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage.

13.4. Any omissions or errors in any sales literature or in any advertising in newspapers, magazines, on the internet or otherwise or in any invoice or other document issued by us may be corrected by us without liability.
